Smullyan in [Smu61] identified the recursion theoretic essence of incompleteness results such as Gödel's first incompleteness theorem and Rosser's theorem. Smullyan showed that, for sufficiently complex theories, the collection of provable formulae and the collection of refutable formulae are effectively inseparable—where formulae and their Gödel numbers are identified. This paper gives a similar treatment for proof speed-up. We say that a formal system S1is speedable over another system S0on a set of formulaeAiff, for each recursive functionh, there is a formulaαinAsuch (...) that the length of the shortest proof ofαin S0is larger thanhof the shortest proof ofαin S1. This paper addresses the nurse manager's role regarding chemically-dependent nurses in the workplace. The manager may intervene by: terminating the contract of the impaired colleague; notifying a disciplinary committee; consulting with a counselling committee; or referring the impaired nurse to an employee assistance programme. A dilemma may arise about which of these interventions is ethically the best. The ethical theories relevant to nursing involve ethical relativism, utilitarianism, Kantian ethics, Kohlberg's justice, and Gilligan's ethic of care. Nurse managers first need to (...) understand these theories in order to clarify their own perceptions and attitudes towards chemical dependency, and then satisfactorily resolve this ethical dilemma. The aim of this paper is to examine the role of methodology in action research. It begins by showing how, as a form of inquiry concerned with the development of practice, action research is nothing other than a modern 20th century manifestation of the pre‐modern tradition of practical philosophy. It then draws in Gadamer's powerful vindication of the contemporary relevance of practical philosophy in order to show how, by embracing the idea of ‘methodology’, action research functions to sustain a distorted (...) understanding of what practice is. The paper concludes by outlining a non‐methodological view of action research whose chief task is to promote the kind of historical self‐consciousness that the development of practice presupposes and requires. The man or woman of faith living in today's pluralist world must have a theology that will do justice to his or her own faith, and also to the neighbours' - and to the differences between them. Similarly, humanists must have a theory that does justice to their own vision and also to the fact that for most of their fellows on earth the proper way of being human has been one or another of various `religious' ways. This paper investigates some delicate tradeoffs between the generality of an algorithmic learning device and the quality of the programs it learns successfully. There are results to the effect that, thanks to small increases in generality of a learning device, the computational complexity of some successfully learned programs is provably unalterably suboptimal. There are also results in which the complexity of successfully learned programs is asymptotically optimal and the learning device is general, but, still thanks to the generality, some of (...) those optimal, learned programs are provably unalterably information deficient—in some cases, deficient as to safe, algorithmic extractability/provability of the fact that they are even approximately optimal. For these results, the safe, algorithmic methods of information extraction will be by proofs in arbitrary, true, computably axiomatizable extensions of Peano Arithmetic. (shrink)

In the European Union, the General Data Protection Regulation (GDPR) provides comprehensive rules for the processing of personal data. In addition, the EU lawmaker intends to adopt specific rules to protect confidentiality of communications, in a separate ePrivacy Regulation. Some have argued that there is no need for such additional rules for communications confidentiality. This Article discusses the protection of the right to confidentiality of communications in Europe. We look at the right’s origins to assess the rationale for protecting it. (...) We also analyze how the right is currently protected under the European Convention on Human Rights and under EU law. We show that at its core the right to communications confidentiality protects three individual and collective values: privacy, freedom of expression, and trust in communication services. The right aims to ensure that individuals and organizations can safely entrust communication to service providers. Initially, the right protected only postal letters, but it has gradually developed into a strong safeguard for the protection of confidentiality of communications, regardless of the technology used. Hence, the right does not merely serve individual privacy interests, but also other more collective interests that are crucial for the functioning of our information society. We conclude that separate EU rules to protect communications confidentiality, next to the GDPR, are justified and necessary. (shrink)

This book explores African philosophic sagacity, or wisdom philosophy, as proposed by Odera Oruka in his “Four Trends in Current African Philosophy” (1981), which he later expanded to six trends (1998). Oruka defines philosophic sagacity as wisdom philosophy, or philosophy of the wise men of Africa who are independent, liberal and non-conformist thinkers, and who often deviate from the accepted common norms of their societies. This book takes philosophic sagacity discourse beyond Oruka’s definition by encompassing traditional wise sayings and proverbs. (...) It combines individual liberal thinkers and the communal ideas, and cherishes both rational and emotional engagement, offering a broader understanding of African philosophic sagacity. This symposium begins with a critique by Paul Hirst of Wilfred Carr's ‘Philosophy and Education’(Journal of Philosophy of Education, 2004, 38.1), where Carr argues that philosophy of education should be concerned with ‘practical philosophy’ rather than ‘theoretical philosophy’. Hirst argues that the philosophy of education is best understood as a distinctive area of academic philosophy, in which the exercise of theoretical reason contributes critically to the development of rational educational practices and their discourse. While he acknowledges that these practices (...) and their discourse must of their nature be directly developed in the exercise of practical reason, or phronesis, the notion of ‘practical philosophy’ is rejected as ultimately incoherent and illusory. In his reply to Hirst's critique, Carr identifies three central claims in Hirst's argument and takes issue with each of these. He reaffirms the need to draw upon the resources afforded by the Aristotelian tradition of practical philosophy in order to identify inadequacies in our present understanding of how philosophy is related to education. He suggests that it is only through bringing their own ‘prejudices’ into critical confrontation with this tradition that philosophers of education will be able to assess whether practical philosophy is incoherent and illusory, as Hirst claims, or whether it is indispensable to the future development of their discipline. In a rejoinder to Carr, Hirst, defends the claim that philosophy of education is a social practice concerned with developing justifiable propositional accounts of the conceptual relations, justificatory procedures and presuppositions of educational practices. He rejects the argument that this ‘theoretical philosophy’ approach must be replaced by that of a new ‘practical philosophy’. (shrink)

This article offers a novel interpretation of Karl Popper’s influential yet controversial book, The Open Society and Its Enemies (1945). Popper, it argues, sheds light on a pivotal social and political question: How can we value genuine human plurality without succumbing to the illusion that enmity can be removed from the socio-political realm? What we find in Popper, I argue, is an “anti-utopian agonism,” that is, his conception of an open society harbors significant agonistic elements—a commitment to human plurality, an (...) endorsement of (some) social and political struggles, and an acute awareness of the tragic dimensions of political life. Simultaneously, Popper’s distinctive anti-utopianism makes an important contribution to agonistic theory on two fronts. First, his concept of “the strain of civilization” reveals a deeper notion of tragedy, which gives him the edge over the rather shallow notion of tragedy we find in the agonistic tradition. Secondly, he develops a tripartite notion of enmity, which is theoretically interesting and practically relevant. The aim of this article is not only to contribute to the scholarship on Popper and agonism but, first and foremost, to demonstrate how The Open Society still matters as an inspiring work that illuminates the practically relevant question of how to value diversity without illusions. The present article discusses the “peace versus justice” dilemma in international criminal justice through the lenses of the respective legal theories of Judith Shklar and Hannah Arendt—two thinkers who have recently been described as theorists of international criminal law. The article claims that in interventions carried out by the International Criminal Court, there is an ever-present potentiality for the “peace versus justice” dilemma to occur. Unfortunately, there is no abstract solution to this problem, insofar as ICC interventions will in some (...) cases be conducive while in others, they will be deleterious to peace. If a tension between peace and justice arises in a particular case, the article asserts, the former must be prioritised over the latter. Such a prioritisation, however, requires a vision of the ICC as a flexible actor of world politics which is situated at the intersection of law, ethics and politics, rather than a strictly legalistic view of the court. Ultimately, then, the present article seeks to probe whether the legal and political theories of Shklar and Arendt—in isolation, but ultimately also in combination—support such a flexible vision of the ICC. This article addresses two questions: How should a ‘practical political theory’ approach the ideological struggle between advocates of critical social justice and defenders of free speech? And, what does this conflict tell us about the deficits of one particular tradition of practical political theory — namely, agonistic democracy? The paper’s purpose, then, is to illuminate a concrete contemporary phenomenon through the lens of agonistic theory and, conversely, to use this struggle as an impetus to carve out and address weaknesses in (...) the theory of agonism.I defend an ‘agonistic approach’ to the struggle against two alternatives — first, the claim that there is, conceptually, no ‘real’ conflict between social justice and free speech, and second, the strategy to ‘take sides’ in the conflict. By taking seriously the agonistic core idea that struggle and conflict can be valuable and productive expressions of plurality and inclusivity, I argue that this struggle should be approached as an agonistic conflict — as the welcome and important expression of a diversity of views on central social, moral and political questions.I also show, however, how retaining the focus on the real-life struggle between advocates of critical social justice and free-speech sheds light on the inconsistencies of much agonistic thought. In particular, I will criticize those agonists who limit their conception of the ‘agon’ to respectful struggles, and those who see the agon merely as a tool of emancipation for oppressed groups. Against these visions of agonism, I develop an anti-perfectionist, yet radical, account of agonism with the potential to serve as a guide in complex social and political conflicts. (shrink)

In quantum mechanics, the state of an individual particle (or system) is unobservable, i.e., it cannot be determined experimentally, even in principle. However, the notion of “measuring a state” is meaningful if it refers to anensemble of similarly prepared particles, i.e., the question may be addressed: Is it possible to determine experimentally the state operator (density matrix) into which a given preparation procedure puts particles. After reviewing the previous work on this problem, we give simple procedures, in the line of (...) Lamb's operational interpretation of quantum mechanics, for measuring a translational state operator (whether pure or mixed), via its Wigner function. These procedures closely parallel methods that might be used in classical mechanics to determine a true phase space probability distribution; thus, the Wigner function simulates such a distribution not only formally, but operationally also. There is no way to determine what the wave function (or state vector) of a system is—if arbitrarily given, there is no way to “measure” its wave function. Clearly, such a measurement would have to result in afunction of several variables, not in a relatively small set ofnumbers .... In order to verify the [quantum] theory in its generality, at least a succession of two measurements are needed. There is in general no way to determine the original state of the system, but having produced a definite state by a first measurement, the probabilities of the outcomes of a second measurement are then given by the theory.E. This essay engages critically with Adrian Pabst’s ‘Liberal World Order and Its Critics’, Christian Reus-Smit’s ‘On Cultural Diversity’, and Hal Brands’ and Charles Edel’s ‘The Lessons of Tragedy’. What holds these three (very different) books together is that they revolve around the theme of ‘the crisis of liberal world order’. In this essay, I do not wish to dispute the claim that the liberal world order is in crisis – indeed, I accept this common starting-off point of the four authors (...) as a fact. What distinguishes my take on the ‘crisis of liberal world’ order from the books under review, however, is that I develop an alternative angle on the very idea of ‘crisis’: By understanding crisis as an incitement to judgement, deliberation and, ultimately, political action, I excavate the constructive potential of crisis; and, through the critical engagement with the three books under review, I seek to lay bare the intimate bond that connects ‘crisis’, ‘human diversity’, and ‘tragedy’, and to revive the constructive potential of these themes as ‘opportunities not to be wasted’. Recent International Relations scholarship has identified ‘societal multiplicity’ as the ontological concept that gives IR its identity as an academic discipline. My article, by contrast, addresses the question: What are the consequences, that is, the positive potential and the necessary costs, of understanding multiplicity as a moral-political value in world politics? The question is important because, in contrast to the focus on multiplicity as the ontology of IR, it allows us to develop a more radically democratic idea of multiplicity as (...) a value in world politics. To address this question, I will bring Rosenberg’s conception of societal multiplicity into conversation with the radically democratic idea of Tully’s ‘strange multiplicity’ and draw out the consequences of such a normative turn. My argument is that while Rosenberg does not frame multiplicity as a value, Tully’s normative understanding of the concept harbours enormous potential to transform oppressive and dominating practices in world politics. However, I will also show that Tully’s general rejection of all forms of domination comes at a price that must not be underestimated. It is of crucial importance to get a clear picture of these consequences as we must decide whether or not this price is, ultimately, worth paying. (shrink)

For the traditional legalistic discourse on the International Criminal Court, “politics” is a bête noire that compromises the independence of the Court and thus needs to be avoided and overcome. In response to this legalistic approach, a burgeoning body of literature insists that the Court does not exist and operate “beyond politics”, arguing that the ICC is an institution where law and politics are intimately connected. The present article seeks to contribute to this “non-traditional” literature by addressing two of its (...) fundamental weaknesses: First, writers of the “non-traditional camp” often present a rather limited view of “politics”; in particular, they have shied away from taking the radical step of portraying and analysing the ICC as a “political actor”. This undermines both its critical and constructive potential. Secondly, these commentators offer a simplistic explanation as to why “traditionalists” treat politics as the ICC’s bête noire: Traditionalists, they claim, are “legalists” with scant interest in and understanding of politics. By focusing on the ICC’s nature as a political actor, this article does not only paint a more nuanced picture of the ICC but also demonstrates the constructive potential of this understanding of the ICC to shed light on the so-called “peace versus justice dilemma”. And secondly, it demonstrates that precisely because the ICC is and ought to be a prudent political actor, it must officially disavow politics. The “noble lie” of disavowing politics, therefore, is a prudential strategy to avoid dangerous moral and political consequences and, ultimately, to secure the continued existence of the ICC itself. It has been reported by some studies that the desire to be involved in decisions concerning one’s healthcare especially with regard to obtaining informed consent is related to educational status. The purpose of this study, therefore, is to assess the influence of educational status on attitude towards informed consent practice in three south-eastern Nigerian communities.

This book reassesses Gadamer's hermeneutics by bringing it into a dialogue with John McDowell's minimal empiricism. It employs the resources of McDowell's minimal empiricism to address the transcendental and ontological presuppositions for objective experience and understanding, while retaining Gadamer's emphasis on the historicity of understanding. By means of the dialogue with McDowell, the book develops a hermeneutical conception of objectivity and perceptual experience, which also entails reinterpretations of Gadamer's notions of tradition, practical wisdom and meaning. The book explores the philosophical (...) space beyond the analytic-Continental divide and demonstrates that hermeneutics is not limited to a reflection on understanding as it is practiced in the human sciences, but can be revived as a distinct and cogent philosophical approach with a transcendental and ontological dimension. Thaning's book is a richly detailed, well-argued and coherent presentation of a defensible, and potentially very important, philosophical position. It demonstrates an impressively deep understanding of the literature both from the phenomenological tradition and from the part of the analytical tradition, inspired by Wilfred Sellars, to which John McDowell belongs. Being a substantial philosophical achievement in its own right, the book raises far-reaching questions that will be of interest to a wide audience. Dr. Steven Crowell, Rice University, Houston (USA) Morten Thaning's book is an important contribution to the discourse of philosophical hermeneutics. Thaning extensively discusses a topic, which recent debates have touched upon, but which up to now has not been the subject matter of concentrated scholarly work: the relation between Gadamer's hermeneutics and McDowell's empiricism. Much has been written about Wilfred Cantwell Smith's account of the nature of religion, particularly by those who, broadly speaking, may be called Religionswissenschaftler. Surprisingly little, though, has been written about his theology. In part at least, this can be attributed to the incipience of his theological thought within the broad parameters of his studies of religion. Theological ideas have been more imbedded in the wealth of materials aimed at the elucidation of the nature of belief, faith, religious truth, (...) and cumulative tradition than presented in any overt and systematic way. But the recent appearance of the third volume of his trilogy, Towards a World Theology, enables us to concentrate more directly on his theological thought and, in light of this, to reflect upon the theological nuances of his earlier work.
